COMMON GROUND VOLUNTEERS Volunteer Agreement - Release and Waiver of Liability Disclaimer
(“Volunteer”) releases Common Ground Volunteers, and any additional parties if applicable, such as sponsors/donors and their respective affiliates, directors, officers, trustees, employees, sponsors, donors, volunteers and agents (collectively, the “Released Parties”). The Volunteer desires to provide volunteer services for the Released Parties and engage in activities related to serving as a volunteer.
Volunteer understands that the scope of Volunteer’s relationship with the Released Parties is limited to a volunteer position and that no compensation is expected in return for services provided by Volunteer; that the Released Parties will not provide any benefits traditionally associated with employment to Volunteer; and that Volunteer is responsible for their own insurance coverage in the event of personal injury or illness as a result of Volunteer’s services to the Companies.
1. Waiver and Release: In consideration of and in order to be allowed to participate in volunteer activities, I, the Volunteer, release and forever discharge and hold harmless the Released Parties and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from the services I provide to the Released Parties. I understand and acknowledge that this Release discharges the Released Parties from any liability or claim that I may have against the Released Parties with respect to bodily injury, personal injury, illness, death, or property damage that may occur while I am providing volunteer services.
2. Medical Treatment: I consent to the use of first aid treatment and the use of generic and over the counter medications and treatments as directed by manufacturer labels, whether administered by the Released Parties or first aid personnel. In an emergency, I understand the Released Parties may try to contact my chosen emergency contact. If an emergency contact cannot be reached promptly, I hereby authorize the Released Parties to act as an agent for me to consent to any emergency transportation, examination, testing, x-rays, medical, or treatment for me as advised by a physician, dentist or other health care provider. I hereby Release and forever discharge the Released Parties from any claim whatsoever which arises or may hereafter arise on account of any transportation, first-aid treatment, or other medical services rendered in connection with an emergency during my tenure as a volunteer with the Released Parties.
3. Insurance: Further I understand that the Released Parties do not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. Each Volunteer is expected and encouraged to obtain their own health, medical, travel, disability or other insurance coverage. I expressly waive any such claim for compensation or liability on the part of the Released Parties in the event of injury or medical expenses incurred by me.
4. Assumption of Risk: I understand that volunteer activities vary greatly, and may include work that may be hazardous to me, including, but not limited to, exposure to lead, asbestos, mold, COVID-19 or other viruses, which may cause or worsen certain illnesses, especially if I do not wear protective equipment, am exposed for extended periods of time, or have a pre-existing immune system deficiency. I understand that volunteers are always welcome to opt out of any volunteer activity, as desired. I knowingly agree to conduct myself in a safe and prudent manner, to not engage in work that exceeds my personal physical limitations, and to assume all risks and liabilities in association with participation in the programs, both known and unknown, including loss of property, disease, illness, physical and mental harm, and death, or other damages. I hereby expressly assume the risk of injury or harm in the volunteer activities.
5. Confidentiality. I agree that in the course of my participation in volunteer activities, I may have access to personal and/or health care information of other persons. I agree to maintain the confidentiality of such information, to use such information only as necessary to do my job as a volunteer, and to comply with all applicable policies of Common Ground Volunteers regarding such information.
6. Photographic Release: I grant and convey to the Released Parties all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by the Released Parties *in connection with my providing volunteer services to the Released Parties (only). I agree and irrevocably license the use of same in any marketing for the Released Parties including Facebook, Instagram, Twitter or otherwise.
7. Other: As a volunteer, I expressly agree that this Release is intended to be as broad and inclusive as permitted by State law, and that this Release shall be governed by and interpreted in accordance with the State laws. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.
By completing and submitting the website volunteer request form, I express my understanding and intent to enter into this Release and Waiver of Liability willingly and voluntarily.
THIS WAIVER AND RELEASE SHALL BE EFFECTIVE FROM THE DATE BELOW UNTIL REVOKED BY THE VOLUNTEER, OR THE RELEASED PARTIES, IN WRITING.
